Kapanalig, ito ang binibigyan-diin ng Article XI, Section 3, paragraph 4 ng 1987 constitution na kautusan sa Mataas na Kapulungan ng Kongreso o Senado sa aksyon sa isang impeachment case na ipinasa ng Mababang Kapulungan ng Kongreso o Kamara.
Malinaw na kapag natanggap ng Senado ang verified complaint o impeachment resolution na inihain ng one-third ng mga miyembro ng Mababang Kapulungan ng Kongreso ay nararapat na simulan ng Senado ang impeachment trial.. Ibig sabihin Kapanalig, “without delay at walang pag-aaksaya ng oras”.
Hindi maaring i-delay ni Senate President Francis Escudero ang impeachment trial laban kay VP Sara Duterte sa kasong betraying of public trust at graft and corruption dahil hindi kumpleto ang mga Senador. Katwiran ni Escudero, kulang ang mga Senador na didinig sa impeachment complaint dahil matatapos ang termino ng iilan at re-electionist naman ang iba.
Noong pang February 5, 2025 ini-transmit ng Mababang Kapulungan ng Kongreso ang articles of impeachment sa Senado laban kay Vice President Duterte. Bakit nag-aatubili ang Senate President na gumalaw?
Dahil lamang sa 2025 midterm election sa darating ika-12 ng Mayo, hindi na magta-trabaho ang mga Senador? Sa kabila ng dumaraming panawagan na umpisahan na ang impeachment trial ni VP Duterte, nanindigan ang Senate President na sa June 2, 2025 sa pagbubukas ng Kongreso ang impeachment trial.
