Inilabas na ng Malacañang ang Executive Order No. 94 na nagtatatag ng Independent Commission for Infrastructure (ICI) upang magsiyasat sa mga iregularidad at korapsyon sa mga flood-control at iba pang proyektong pang-imprastraktura ng pamahalaan sa nakalipas na sampung taon.
Nilagdaan ni Pangulong Ferdinand R. Marcos Jr. ang kautusan ngayong September 11, 2025.
Ang ICI ay itatatag bilang isang independent at ad hoc fact-finding body na pamumunuan ng isang chairperson kasama ang dalawang miyembro na may matibay na reputasyon sa integridad at pagiging patas.
May kapangyarihan ang komisyon na magsagawa ng imbestigasyon, mag-isyu ng subpoena, mangalap ng ebidensya, at magrekomenda ng pagsasampa ng kaso laban sa mga opisyal ng gobyerno at pribadong indibidwal na mapatunayang sangkot sa mga anomalya.
Ilan sa bahagi ng sinasasaad ng EO 94:
“Recommend to or request from the appropriate authorities or the proper courts, the issuance of a hold departure order or other remedies to monitor or prohibit the travel abroad, or to compel the return from abroad, of any public official or employee, or any other individual, under investigation by the ICI;
Recommend to or request from the appropriate authorities the freezing or seizure of assets, funds, deposits, and properties reasonably believed to be connected to anomalous flood control and other infrastructure projects pending investigation with the ICI;
Transfer evidence and findings, from time to time, to the appropriate prosecutorial authorities for expeditious prosecution, by means of a special or interim report and recommendation, when the ICI finds, in the course of its investigation, that there is reasonable ground to believe that individuals are criminally liable;”
Pangunahing tutukan ng komisyon ang mga flood-control projects, matapos ang sunod-sunod na ulat ng maling paggamit ng pondo at iregularidad sa implementasyon.
Bukod dito, may kapangyarihan ang ICI na magrekomenda ng pag-freeze ng mga ari-arian, pagpigil sa pagbiyahe ng mga iniimbestigahan, at pansamantalang suspensyon upang hindi maapektuhan ang takbo ng imbestigasyon.
Ang mga matutuklasan ng ICI ay maaaring isumite sa Office of the President, Department of Justice, Office of the Ombudsman, at iba pang kaukulang ahensya para sa nararapat na hakbang.
“All local government units, all branches of government, and the private sector, are hereby encouraged to provide full and timely assistance and cooperation to the ICI to ensure effective implementation of this Order.
Section 8. Reporting. The ICI shall provide monthly reports to OP, through the Office of the Executive Secretary. The ICI shall likewise cause the publication of its accomplishments and such other relevant reports,” ayon pa sa EO 94.
Inatasan din ang lahat ng ahensya ng gobyerno na makipagtulungan sa komisyon, at nagbabala sa mga tatangging makiisa—maari silang masampahan ng disciplinary action.
