Kinundina ng In Defense of Human Rights and Dignity Movement (iDefend) ang kasong isinampa ng Quezon City Police laban sa mga nakibahagi sa isinagawang kilos protesta noong nakalipas na State of the Nation Address ni Pangulong Ferdinand “Bongbong” Marcos Jr.
Ayon sa human rights group, maituturing na ‘harassment at intimidation’ ang hakbang ng polisya sa kabila ng kalayaan sa pagpapahayag ng bawat isa na nasasaad sa Saligang Batas.
Giit ng grupo, bahagi ng mga karapatan at kalayaan ng mamamayan sa isang demokratikong bansa ang ‘freedom of assembly and expression’ na siyang ipinamalas ng iba’t ibang mga grupo at batayang sektor sa pagsasagawa ng kilos protesta noong ika-24 ng Hulyo, 2023 kasabay ng ikalawang pag-uulat sa bayan ng pangulo.
“iDefend condemns the charges being filed by the Quezon City Police against its members for peacefully participating in the rallies during the previous State of the Nation Address of President Marcos Jr. This is harassment and intimidation and undermines constitutionally- guaranteed rights. We remind them that the highest law of the land, our Constitution, guarantees the right of the people to exercise the freedom of assembly and expression. Our Constitution instructs that “no law shall be passed abridging the right to freedom of expression”. Ang bahagi ng pahayag ng iDefend.
Ayon sa grupo, walang batayan ang kasong isinampa ng Quezon City Police sapagkat bagamat walang pormal na permit ang isinagawang pagkilos ay natapos naman ito ng maayos at mapayapa ng walang anumang tensyon o karahasan.
“The absence of a permit does not make the rally illegal, unless violence is committed. In fact, if the rally is without permit, the police is obligated to help prevent traffic congestion and allow voluntary dispersal. Since the SONA public action was held and ended peacefully, lauded by PNP itself post-SONA, there should be no cause for these charges.” Dagdag pa ng iDefend.
Una ng inihayag ni Quezon City Police District (QCPD) Director PBGen. Nicolas D Torre III ang pagsasampa ng kaso sa ilang mga miyembro ng militanteng grupo na nakibahagi sa kilos protesta noong SONA dahil sa sinasabing paglabag sa Section 13 (a) ng Batas Pambansa Bldg. 880 o ang Public Assembly Act of 1985.
Sa tala, 14 na mga opisyal at miyembro ng iba’t ibang mga grupo ng batayang sektor ang kabilang sa sasampahan ng kaso ng Quezon City Police.
